Approved yesterday by the Italian Senate Committees I and V, among others, the art. Extension of Terms 22 a decree bringing the moratorium on infringement of design from 5 to 13 years, contrary to the provisions of art. 239 of the Code of Industrial Property, and despite the Community legislation on the subject and the judgment of the Court of Justice on 27/1/2011.
The text is passed in the Senate chamber yesterday and by February 20 will return to the House “sealed” for the final vote.

Right now we announce that the day that will be published in the Official Gazette the text of the measure we will denounce the Italian government to the European Community for the examination of an infringement procedure…”.
In recent weeks the associations, which were obtained with their battle to reduce the moratorium to 5 years, have repeatedly pointed out the risks that would entail the adoption of this article: for companies involved in innovation, research and investments in process and product of the risk of losing competitiveness to the benefit of copiers, for the state conviction to a heavy monetary penalty by the European Community.
“We have sought dialogue with parliamentarians from both Houses and all parties, but unfortunately, it is not understood the seriousness of our complaint and therefore the impact to the detriment of businesses − explains Roberto Snaidero president of FederlegnoArredo. Nowadays, the Government asks entrepreneurs, rightly, fiscal transparency and legality. The introduction of the moratorium to 13 years was lawful counterfeiting. We can not accept that in a delicate world economic time like this where our government is asking all citizens efforts to revive the fortunes of the country and initiate a rapid development of the real economy, on the other hand, the Parliament encourages illegal practices which slow down this process to the detriment of companies.
